Federal Hate Crime Charges Filed Against Idaho Man Who Pleaded Guilty to Murder of Gay Man

An Idaho man pleaded guilty Monday to first-degree murder in the homicide of a gay man authorities say he lured to his death in Lake Lowell. He has additionally been charged with a federal hate crime, to which he pleaded not guilty on Tuesday.

Idaho tellingly does not offer additional protections to LGBT victims, necessitating federal involvement in the case.

Kelly Schneider, 23, of Nampa, took a plea deal in which further charges of robbery, grand theft and conspiracy of robbery were dropped. The victim, Steven Nelson, 49, also of Nampa, clung to life long enough to describe his attackers to authorities after being robbed and beaten on April 29 of last year. Three other men were charged in connection with the reprehensible crime.

According to prosecutors, an online escort ad on Backpage.com was used by Schneider in order to entrap Nelson in the remote area of Gott’s Point. After the grievous assault during which Schneider has confessed to brutally kicking him repeatedly, Nelson was left for dead. Jayson Woods, 28; Kevin R. Tracy, 21; and Daniel Henkel, 23 await their trial, also on first-degree murder charges as well as robbery.

The lurid tale of the men’s participation in the crime is as follows:

Nelson met Schneider at a Walmart in Nampa, then drove with him to Gott’s Point near Lake Lowell. Henkel and Tracy were hiding there as “back-up,” Tracy described, in case Nelson was armed or was going to harm Schneider.

The first time Schneider met with Nelson, Schneider grabbed $40 Nelson offered him in the Walmart parking lot then fled back to the car Woods was driving. No sexual services were exchanged.

Later, according to Tracy, Woods told Schneider to “go make things right” by meeting Nelson again and doing the favors Schneider said he would do. At first, Schneider refused, saying he was straight. Schneider eventually arranged to meet again with Nelson. Nelson offered to pay him more money if Schneider would return, according to the testimony.

Woods dropped Schneider at the same Walmart. This time Schneider and Nelson drove to Gott’s Point. There, Schneider got Nelson on the ground, shoved his head to the dirt and kicked him repeatedly, calling him a “faggot” and asking Nelson why he thought Schneider would return and perform sexual acts.

Henkel fled immediately because he thought Nelson would recognize him, Tracy said. Schneider was to take Nelson’s car and drive Schneider, Henkel and Tracy away.

Schneider now faces life in prison for the murder charge, and potentially another life sentence if convicted of the hate crime, formally known as willful assault based on sexual orientation, resulting in death.

Donald Trump, who lied to congressional leaders that 3-5 million illegal ballots cost him the popular vote in November’s election, is apparently sticking to that false claim, as his Press Secretary Sean Spicer, despite it being widely discredited.

Spicer was grilled about the assertion in today’s press briefing by CNN’s Jeff Zeleny.

“I wonder if you believe that,” Zeleny asked Spicer. “Do you believe there was widespread voter fraud?”

“Listen, my job is not, look.”

“How can he be comfortable with his win, if he believes it was three million votes. Maybe he didn’t win,” asked Zeleny.

“He’s very comfortable with his win,” Spicer replied. “It’s an electoral based system. He got 306 electoral votes. 33 of 50 states voted for him. I’ve asked and answered this question twice. He believes based on the information that has been provided.”

As Spicer moved on, Zeleny kept at him. “What does that mean for democracy, though, Sean. What does that mean for democracy?

“It means I’ve answered your question,” snapped Spicer.

Responded Zeleny: “Have you?”

An outreach coordinator in Arkansas Treasurer Dennis Milligan’s office has resigned after a backlash over his misogynistic and antigay social media posts.

Hunter Hatcher, who is also a member of the Arkansas National Guard, tweeted on Friday, “Y’all in Trump’s America now! Time to flick that chip off ya shoulder and quit being so offended. Gay jokes are back on ya bunch of homos.”

His Twitter account is currently set to private.

On the following day, he shared an article about the Arkansas Women’s March, a sister march of the one held in Washington, D.C., including a sexist remark.

“If all these women are at the Capitol, who’s making lunch?” he wrote.

On Jan. 1 he made a Facebook post with a similar message.

“I love Subway cause I can tell a woman to make me a sandwich and she does it with a smile on her face…Don’t get equal, get to cooking woman, get equal on your own time,” he wrote.

“It is my intent to focus on my military service to my country,” Hatcher’s emailed resignation reads. “I would like to offer my sincere apologies to all who were offended by my egregious remarks, as it was not becoming of a Soldier. I am very contrite but will continue to focus on my mission with the Army.”

“We are obviously very disappointed in some recent outbursts on social media by one of our employees who is currently on military leave,” Milligan wrote Sunday. “Insinuating that women belong only in the home is insulting. These statements, and the others he made, in no way represent the views of the Treasurer, who does not and has never held such audacious viewpoints.”

He made another statement the following day.

“I want to reemphasize my earlier statement: The comments made by a member of my staff were insulting, unprofessional, unbecoming of a state employee and have no place in a public office,” Milligan said in the follow-up statement. “Again, he is on unpaid military leave from my office at this time. When he returns we will be discussing this situation and his role within my office.”

Hatcher has also faced consequences from the National Guard.

His commander in Texas took away his computer and phone privileges as of Monday morning, according to Arkansas Army National Guard Spokesperson, Lieutenant Colonel Joel Lynch, KATV reports.

“He should not have posted that, we encourage and actually tell all of our soldiers and airmen that they represent the organization all the time, whether it’s on social media, when you’re walking downtown, when you’re in public…you’re always representing the organization and we do not tolerate that kind of behavior,” Lynch said.

Some consequences include a reduction in rank, or being kicked off the deployment Hatcher is scheduled for in Africa.

“It’s very clear when we have training on this every year, we have policies and they’re posted on all of the facilities that we’re at so it’s not a mystery that we feel this way,” Lynch added.

CofE-colour1In an attempt to become more inclusive, the Church of England is being urged to turn to blind eye to the sex lives of clergy members.

In order to continue in same-sex relationships, gay clergy members are currently asked to remain celibate, change jobs or seek out a promotion to Bishop.

However, a motion to be discussed in the House of Bishops next month could allow the church to become more open about homosexuality.

The new proposal comes as the Church of England faces mounting pressure to become more open to homosexuality.

If no movement is made to increase acceptance and intolerance, members have suggested that they will engage in protest in the form of civil disobedience. For example, celebrating marriages elsewhere.

However, gay Labour MP Ben Bradshaw (above) said the new policy would promote secrecy while continuing to expect gay clergy to remain celibate. “It is progress for them to stop asking the celibacy question,” he said “but it still leaves the Church of England policy based essentially on dishonesty and encouraging its clergy to lie.”
