Alabama Senate Passes Anti-LGBTQ Bill; HRC Alabama Calls on Governor Ivey To Reject It

Today, HRC denounced the Alabama State Senate and Senate President Pro Tem Del Marsh for passing the anti-LGBTQ H.B. 24. HRC Alabama calls upon Governor Kay Ivey to not sign this bill, which would most harm the children in Alabama’s child welfare system.

The bill, deceptively titled the “Child Placing Agency Inclusion Act,” would enshrine discrimination into Alabama law by allowing state-licensed adoption and foster care agencies to reject qualified prospective LGBTQ adoptive or foster parents based on the agency’s religious beliefs.

“Plain and simple — H.B. 24 is discrimination dressed up as a ‘solution’ to a fake problem,” said Eva Kendrick, HRC Alabama State Director. “It creates an unnecessary hardship for potential LGBTQ adoptive or foster parents in Alabama and primarily harms the children looking for a loving home. It’s unfortunate that leaders continue to push this bill, even as child welfare organizations, faith leaders and fair-minded Alabamians are standing up and calling this bill out for what it is: discrimination. We now ask Governor Kay Ivey to not sign into law this harmful bill.”

As of this morning, more than 50 faith leaders have joined an open letter to legislators in Montgomery opposing this unnecessary, harmful bill. In it, they note their faith does not call for them to discriminate, but instead, to serve all — regardless of sexual orientation, gender identity or any other perceived “difference.”

H.B. 24 would allow state-licensed child-placing agencies to disregard the best interest of children, and turn away qualified Alabamians seeking to care for a child in need — including LGBTQ couples, interfaith couples, single parents, married couples in which one prospective parent has previously been divorced, or other parents to whom the agency has a religious objection. The measure would even allow agencies to refuse to place foster children with members of their own extended families — a practice often considered to be in the best interest of the child. A qualified, loving LGBTQ grandparent, for example, could be deemed unsuitable under the proposed law.

Research consistently shows that LGBTQ youth are overrepresented in the foster care system, as many have been rejected by their families of origin because of their LGBTQ status, and are especially vulnerable to discrimination and mistreatment while in foster care. This bill would only exacerbate the challenges faced by LGBTQ young people.

Tennessee State Senate Committee approves #SlateofHate's dangerous “LGBTQ Erasure Bill”

Sarah Kate Ellis, President and CEO of GLAAD – the world’s LGBTQ media advocacy organization, released the following statement after the Tennessee State Judiciary Committee approved Senate Bill 1085, a measure that’s a part of Tennessee’s #SlateofHate. If signed into law, SB 1085 could invalidate marriages of LGBTQ couples and legal documents that affirm a transgender person’s true identity by stating that any “undefined” words be given their “natural and ordinary meaning.”

“The Tennessee State Senate is trying to sneak through an anti-LGBTQ bill that uses carefully worded language to hide its attempt to discriminate against LGBTQ Tennesseans. This mean-spirited bill could undermine marriages of gay and lesbian couples and nullify a transgender person’s true identity under law. Lawmakers should be spending time improving lives not pushing forward state-sanction discrimination.”

BACKGROUND INFORMATION: TENNESSEE’S REMAINING #SLATEOFHATE

SB30/HB33 – Requires words “father,” “mother,” “husband,” and “wife” be “based on the biological distinctions between men and women,” thereby targeting LGBTQ parents and couples.

  • Especially impacting LGBTQ families, a child’s parent, if not the biological parent, might not be recognized as such by law
  • Transgender people’s gender identity may not be recognized by law

SB1085/HB1111. – States any “undefined” words be given their so-called “natural and ordinary meaning,” opening non-traditional/LGBTQ couples and families up to discrimination.

  • Affects every undefined word in the Tennessee code
  • May interfere with the marriages of same-sex couples and LGBTQ families
  • Transgender people’s gender identity may not be recognized by law

SB1153/HB1406 – Claims children conceived through artificial insemination are not “legitimate” children of their parents by repealing statue that protects them.

  • Targets LGBTQ couples, single parents, and their children
  • Allows the government to refuse to recognize LGBTQ families and only list one parent
  • Creates roadblocks for LGBTQ parents trying to adopt their own children

Police Investigating Hate Letter Threatening Toronto Pride Parade

A hate letter filled with homophobic language and including threatening references to Toronto’s Pride parade was sent to the office of the only LGBT-identified city councilor, Kristyn Wong-Tam, this past Wednesday.

A line from the letter reads: “Now with the police not at your f_g parade, it makes it easy to hurt you all in a big way.”

“I think it’s really important for us to recognize that when language that is used is hateful and discriminatory, it actually creates a climate of fear and violence,” Wong-Tam said. “It can lead to violence, and I don’t want people to feel unsafe.”

After contacting security at City Hall, Wong-Tam and her team were told to report the incident to Toronto Police, who is now investigating.

The return address listed on the envelope is that of CityNews, a publication that is itself under investigation for its neo-Nazi views and imagery. Its editor-in-chief has denied any association with the letter, and police are considering the possibility that the address was used as a misdirection.

Wong-Tam noted the irony that she received the hateful missive on the Day of Pink, an international observance against bullying, discrimination, homophobia and transphobia.

She also thanked supporters for their expressions of solidarity in reaction to the letter in a follow-up tweet: “Thank you everyone for the positive messages. You represent the best of Toronto.”
