HRC Calls on Trump Admin. to Reinstate Sexual Orientation Question in National Senior Survey

HRC lambasted the Trump Administration’s Department of Health and Human Services’ (HHS) Administration for Community Living (ALC) for removing a question about sexual orientation from the National Survey of Older Americans Act Participants (NSOAAP), an annual national survey of recipients of select services under the Older Americans Act (OAA). Removing this critical question was the only change made to the survey.

“Today, there are an estimated 1.5 million LGBTQ seniors in America. This is an extremely vulnerable population, many of whom will have to face the challenges of advanced age or illness without the traditional support systems and legal protections that other seniors can take for granted,” said HRC Government Affairs Director David Stacy. “If we do not collect data on LGBTQ seniors, policymakers and advocates can not know the extent of the problems they face. HRC implores the Trump Administration to add this crucial question back to the NSOAAP and expand their questions to include data collection on gender identity.”

The survey obtains performance outcome information, identifies service gaps and supports improvements in programs serving older Americans. For the past three years, ACL has issued the NSOAAP with the question about sexual orientation intact. After previously stating there were no changes to the survey, HHS removed the question on sexual orientation, making it more difficult to track issues senior LGBTQ Americans face.

In addition to this action, two weeks ago, the Department of Housing and Urban Development (HUD) withdrew two notices impacting LGBTQ people.  The first notice withdrew a requirement for emergency shelters receiving HUD funding to post information about LGBTQ people’s rights to access shelter safely and in accordance with their gender identity.  The second notice withdrew critical data collection and implementation guidelines for a homelessness prevention initiative targeting LGBTQ youth.

HRC has long advocated for better data collection regarding the LGBTQ population. Several U.S. agencies have already taken steps to do so including the Department of Education, which has added sexual orientation and gender identity questions to the 2016 School Survey on Crime and Safety (SSOCS); the Department of Health and Human Services, which added sexual orientation and gender identity data collection to its requirements for Electronic Health Records (EHRs) certified under the Meaningful Use program; and the FBI, which collects statistics on hate crimes committed based on sexual orientation and gender identity, among other characteristics, in its annual Hate Crimes Statistics reports.

Sarah Kate Ellis, President and CEO of GLAAD, released the following statement after a Center for American Progress report discovered that the Trump Administration erased the LGBTQ community from The National Survey of Older Americans Act Participants and the Annual Program Performance Report for Centers for Independent Living, key surveys that are used to help provide care to American seniors – including disability, transportation, and caregiver support needs.

“The Trump Administration is literally attempting to erase the LGBTQ community from the fabric of American history. Our LGBTQ seniors, many of whom survived the HIV and AIDS epidemic, do not deserve to have the government once again brush them off from obtaining transportation services, caregiver support, and even delivered meals that fit their needs. Access to these services is an American right, and this heartless move proves how anti-LGBTQ the Trump Administration has always been from Day One.”

Trump Administration Removes LGBTQ Content From Federal Websites. “…LGBTQ advocacy groups also condemned the Trump administration for removing all mention of LGBTQ people from the White House website on the day of Trump’s presidential inauguration. In addition to the State Department and White House removals, LGBTQ content has also been scrubbed from other federal agency websites. A report titled “Advancing LGBT Workplace Rights” was removed from the U.S. Department of Labor website, while other LGBTQ-themed webpages remained. [NBC News, 1.24.17]

Kentucky Governor Signs Anti-LGBTQ SB 17 into Law

The Human Rights Campaign called out Governor Matt Bevin for signing SB 17 into law, a measure that allows student groups at colleges, universities, and high schools to discriminate against LGBTQ students.

“Governor Bevin’s shameful decision to sign this discriminatory bill into law jeopardizes non-discrimination policies at public high schools, colleges, and universities,” said HRC Legal Director Sarah Warbelow. “No student should fear being excluded from a school club or participating in a school activity because they are LGBTQ. While of course private groups should have the freedom to express religious viewpoints, they should not be able to unfairly discriminate with taxpayer funds.”

SB 17 undermines inclusive “all comers” policies at public colleges, universities, and now high schools, by allowing student organizations to discriminate against students under the guise of religion. Many public colleges and universities have long had “all-comers” policies that require student organizations receiving financial and other support from the institution not to discriminate against students based on race, sex, religion, sexual orientation or gender identity. These policies are important because they allow all members of the student body to participate in students groups and prevent such groups from discriminating against students with state funding. The Supreme Court upheld these all-comers policies as constitutional in the Christian Legal Society v. Martinez decision in 2010.

The attack on fairness and equality in Kentucky is part of an onslaught of bills being pushed in 2017 by anti-equality activists around the country. HRC is currently tracking more than 100 anti-LGBTQ legislative proposals in 30 states. For more information, visit hrc.im/2017legislature.

YouTube ‘Looking Into’ Claims from Vloggers and Musicians of Broad Censorship of LGBTQ Content: WATCH

After claims by LGBTQ YouTubers that YouTube’s ‘Restricted Mode’ filters are hiding videos with LGBTQ content, the video giant says it is looking into it.

Said YouTube in a statement on its YouTube Creators account:

“We are so proud to represent LGBTQ+ voices on our platform—they’re a key part of what YouTube is all about. The intention of Restricted Mode is to filter out mature content for the tiny subset of our users who want a more limited experience. LGBTQ+ videos are available in Restricted Mode, but videos that discuss more sensitive issues may not be. We regret any confusion this has caused and are looking into your concerns. We appreciate your feedback and passion for making YouTube such an inclusive, diverse, and vibrant community.”

On Thursday, vlogger Rowan Ellis posted a video about the situation, spurring other YouTubers to speak up:

TechCrunch reports:

In addition, the hashtags #YouTubeIsOverParty and #YouTubeRestricted started trending on Twitter over the weekend, with other users reporting that their videos about LGBT topics were hidden in Restricted Mode.

According to YouTube, Restricted Mode relies on “community flagging, age-restrictions, and other signals to identify and filter out potentially inappropriate content.” It is frequently used by parents, as well as schools, libraries and other institutions, to keep children from finding videos with porn, graphic violence and other objectionable content.

Videos referencing same-sex relationships, however, were also being hidden (including one of a lesbian couple’s wedding ceremony, notes Gizmodo). Ellis, who has about 22,600 subscribers and focuses on “pop culture from a feminist and queer perspective,” according to her YouTube bio, claimed that about 40 of her videos had been filtered out of Restricted Mode.

Even pop stars Tegan and Sara have been affected:
