Dream becomes nightmare: Dany Vargas saw her loved ones deported and now faces ouster

Despite Trump administration assurances that only violent individuals are being targeted for deportation, many others, including LGBTQ immigrants are being rounded up and face ouster. Daniela Vargas, 22, hid in fear and for hours in a closet as agents who’d come to family home detained her brother and father, whom they sent back to Argentina, according to press reports. Then, after she spoke at a rally about their deportation, the Jackson, Mississippi resident was herself detained and faces deportation. Vargas, who was brought to the U.S. as a child, had DACA status (Deferred Action for Childhood Arrivals), which had lapsed, but for which she now hopes to apply for renewal.

Thousands have rallied to support her, including the more than 25,000 who signed the “Free Dany” petition asking she not be deported.

There are roughly 750,000 people who received protection under DACA, a program instituted by the Obama administration that allows certain undocumented immigrants who entered the U.S. as minors to receive a renewable two-year period of deferred action from deportation.

Advocates in El Paso, Texas are also concerned about a transgender woman who was waiting in a courthouse to file a protective order against an abusive boyfriend when she was arrested in early February. Media reports appear to use a birth name for the woman, identified as Ms. González. “There’s really a sense now that you can be apprehended at any time,” Fernando Garcia, director of the Border Network for Human Rights, in El Paso told the New Yorker. Ms. González’s arrest, the magazine writes, showed that “you might not be protected even if you are the victim of a crime or abuse.”

Advocates have started a petition to free González.

Ben Carson referred to slaves as “immigrants” in his first speech as Secretary of Housing and Urban Development today, addressing a room full of federal workers.

Said Carson:

“That’s what America is about. A land of dreams and opportunity. There were other immigrants who came here in the bottom of slave ships, worked even longer, even harder for less. But they, too, had a dream that one day their sons, daughters, grandsons, granddaughters, great grandsons, great granddaughters might pursue prosperity and happiness in this land.”

Kentucky Legislature Sends Anti-LGBTQ SB 17 to Governor’s Desk

Today, HRC called on Governor Matt Bevin to veto SB 17, a bill that would, among other things, allow student groups at colleges, universities, and high schools to discriminate against LGBTQ students. The bill passed the Kentucky House in an 81 to 8 vote after passing through the Senate last month.

“This discriminatory legislation goes beyond protecting students’ already secured First Amendment rights and would allow, in part, student groups, at colleges, universities and high schools to discriminate against LGBTQ students and still receive public funding,” said HRC Legal Director Sarah Warbelow. “We call on Governor Bevin to veto this legislation. All students should have the opportunity to fully participate in school programs, and no public school should have a license to discriminate against LGBTQ students.”

SB 17 undermines inclusive “all comers” policies at public colleges, universities, and now high schools, by allowing student organizations to discriminate against students under the guise of religious freedom. Many public colleges and universities have long had “all-comers” policies that require that student organizations that receive financial and other support from the institute of higher education do not discriminate against students based on race, sex, religion, sexual orientation or gender identity. These policies are important because they allow all members of the student body to participate in students groups and prevent such groups from discriminating against students with state funding. The Supreme Court upheld these all-comers policies as constitutional in the Christian Legal Society v. Martinez decision in 2010.

The attack on fairness and equality in Kentucky is part of an onslaught of bills being pushed in 2017 by anti-equality activists around the country. HRC is currently tracking more than 100 anti-LGBTQ legislative proposals in 29 states. For more information, visit hrc.im/2017legislature.

HRC Joins Thought Leaders at Harvard LGBTQ Conference

At the end of February, HRC’s Ty Cobb and Ben Needham spoke at the 2017 Harvard LGBTQ Conference. Cobb directs HRC’s global programs and Needham directs Project One America, HRC’s programs in Alabama, Arkansas, and Mississippi.

Harvard’s annual LGBTQ conference, which gathers thought leaders to discuss issues pertinent to the LGBTQ community, comes at a time at a pertinent time the domestic and international LGBTQ community. LGBTQ people continue to face hostility from populist and nationalist movements, including movements that approved Brexit and the election of President Donald Trump.

Cobb was featured in this year’s keynote panel, The Future of Global LGBTQ Rights, alongside Astraea Foundation Executive Director J. Bob Alotta, World Bank SOGI Advisor Clifton Cortez and Harvard Kennedy School Ford Foundation Mason Fellow David Razú Aznar. The panel discussed the challenges that the international LGBTQ community faces and how those challenges can be addressed.

“We need to show up everywhere,” Cobb explained, when asked about the Trump Administration. “By joining others we are creating power…power that the current administration won’t be able to ignore.”

Needham joined Crystal Richardson, Legal Director of the Campaign for Southern Equality’s Rapid Response Initiative and HRC North Carolina Steering Committee member, to discuss grassroots organizing in the American South.

“The principles of organizing aren’t different in the Deep South,” Needham said during his opening statement. “The challenges to organizing in the Deep South are the lack of protections for the LGBTQ community. So many people are still afraid of losing their jobs and being kicked out of their homes because of who they are and who they love which means we have to be more creative with how we use those organizing principles.”

In 2014, HRC launched Project One America, an initiative geared towards advancing social, institutional and legal equality in Mississippi, Alabama and Arkansas. Last month, Project One America released several videos in a series titled “#LoveYourNeighbor,” a storytelling project focused on sharing the experiences of LGBTQ people and allies in Tupelo, Mississippi.
