\ufeff<\/span><\/p>\n James Miller, an Austin man<\/a>, was sentenced to 10 years probation for the \u201ccriminally negligent homicide\u201d of his neighbor Daniel Spencer after arguing that he killed in self-defense after Spencer came on to him.<\/p>\n KXAN reports<\/a>:<\/p>\n The defense argued Miller stabbed his neighbor\u00a0when Spencer allegedly came on to him. The prosecution argued blood evidence didn\u2019t match Miller\u2019s story. However,\u00a0Foye says the jury did its best with a hard trial.<\/p>\n \u201cWe don\u2019t know exactly what did happen in that house that night,\u201d Foye said, \u201cSo that can be something that can be very difficult for juries to work through.\u201d<\/p>\n Defense attorney Charlie Baird said he\u2019d hoped Miller wouldn\u2019t have to serve any time.<\/p>\n \u201cWe were disappointed with the verdict yesterday, when he was convicted of criminally negligent homicide,\u201d Baird said.\u00a0\u201cWe thought that he should have been acquitted on the basis of self-defense.\u201d<\/p>\n Miller was also ordered to \u201c[undertake] 100 hours of community service, pay nearly $11,000 in restitution to the victim\u2019s family and use a portable alcohol monitoring device for at least a year.\u201d<\/p>\n The post Austin Man Gets 10 Years Probation for Murder of Neighbor After Using \u2018Gay Panic\u2019 Defense<\/a> appeared first on Towleroad<\/a>.<\/p>\n
