<\/p>\nWasting No Time, Hawaii Challenges Trump\u2019s Travel Ban Rules<\/b><\/p>\n

Wasting no time, the Attorney General of the State of Hawaii has challenged Trump\u2019s cruel and rigid guidance<\/a> on family relationships implementing the 90-day Muslim travel ban. Hawaii, joined by former Solicitor General, current partner at Hogan Lovells, and professor at Georgetown University Law Center, Neal Katyal, argue that Trump violated the Court\u2019s order when it arbitrarily excluded certain family members from being able to come into the country.<\/p>\n As we discussed earlier<\/a>, Trump is allowed to implement his travel ban against\u00a0\u201cforeign nationals abroad who have no connection to the United States at all.\u201d He is not allowed to stop those with \u201ca credible claim of a bona fide relationship with a person or entity in the United States.\u201d That\u2019s from the Supreme Court\u2019s order.<\/p>\n But Trump decided to change the distinction between \u201cbona fide relationship\u201d and \u201cno connection\u201d to \u201csuper close family\u201d and \u201cnot close enough.\u201d He decided, among other things, that\u00a0fianc<\/span>\u00e9<\/span>s, grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles,\u00a0<\/span><\/span>nieces, nephews, and cousins of Americans are not allowed in. It is, however, hard to square the Court\u2019s decision to apply the travel ban\u00a0only<\/em> to those with\u00a0zero<\/em> connections to the United States with the Administration\u2019s decision to apply it to many people with family already here.<\/span><\/p>\n Hawaii agrees.<\/p>\n In its motion<\/a>, Hawaii asks for a court order clarifying the Supreme Court\u2019s ruling. Specifically, it wants a court to make clear to whom the travel ban can apply and to whom it can\u2019t. Right now, Trump\u2019s guidance seems inconsistent with the plain language of the Supreme Court\u2019s order.<\/p>\n The Hawaii District Court has given no indication that it plans to issue a quick decision. The judge has asked for briefing by Monday (from the government) and a response from Hawaii (by Thursday). That means the Administration will get a chance to implement its travel ban before the court issues its clarifying order.
