Mike Huckabee: States Can Ignore Supreme Court On Gay Marriage
WASHINGTON — Former Arkansas Gov. Mike Huckabee disputed what he called the “notion of judicial supremacy” on Tuesday, arguing states would have the final say on gay marriage regardless of whether the Supreme Court rules that same-sexcouples have a constitutional right to marry.
Huckabee, a conservative evangelical and potential 2016 presidential candidate, said a Supreme Court ruling, expected this year, would ultimately be moot because “one branch of government does not overrule the other two.”
“One thing I am angry about though … is this notion of judicial supremacy, where if the court makes a decision, I hear governors and even some aspirants to the presidency say, ‘Well that’s settled, it’s the law of the land.’ No, it’s not the law of the land,” Huckabee said in an interview with conservative radio host Hugh Hewitt.
“Constitutionally, the courts cannot make a law, they can interpret one and then the legislature has to create enabling legislation and the executive has to sign it and has to enforce it,” Huckabee added.
A ruling from the high court, however, would not “make law,” but rather would invalidate existing bans on gay marriage as unconstitutional. State legislatures would need no additional law to recognize same-sex marriages. Similar appellate court decisions have already done so in 36 states and the District of Columbia — all of which now recognize same-sex marriages.
This isn’t the first time Huckabee has flirted with the theory of nullification. The comments place him on the far right of his party — even more so than Sen. Ted Cruz (R-Texas), a potential rival in the race for the White House.
If Huckabee felt dismayed by some in his party who have softened their rhetoric on the matter, he didn’t show it on Tuesday.
“I may be lonely, I may be the only one, but I’m going to stand absolutely faithful to the issue of marriage not because it’s a politically expedient thing to do because it isn’t,” he said. “I’m going to do it because I believe it’s the right position, it’s the biblical position, it’s the historical position.”

President Obama Celebrates The Advance of Same-Sex Marriage As 'A Story of Freedom' in State of the Union Address: VIDEO
In his sixth state of the union address Tuesday, President Obama sounded a victorious note, declaring “the shadow of crisis has passed,” referring chiefly to economic challenges that have been center-stage since he was elected to the Presidency in 2008. The President also proclaimed gay marriage to be a civil right, celebrating the sea change in how Americans by and large perceive same-sex marriage:
“I’ve seen something like gay marriage go from a wedge issue used to drive us apart to a story of freedom across our country, a civil right now legal in states that seven in ten Americans call home.”
Speaking of the moral and security imperative at heart in respecting human dignity, the President mentioned the words “lesbian,” “bisexual,” and “transgender” in his speech, marking the first time those words have been used in a state of the union address:
“That’s why we defend free speech, and advocate for political prisoners, and condemn the persecution of women, or religious minorities, or people who are lesbian, gay, bisexual, or transgender. We do these things not only because they’re right, but because they make us safer.”
The President also urged Americans to view difference as a source of strength that should be embraced rather than feared:
“I want future generations to know that we are a people who see our differences as a great gift, that we are a people who value the dignity and worth of every citizen – man and woman, young and old, black and white, Latino and Asian, immigrant and Native American, gay and straight, Americans with mental illness or physical disability.”

Transgender, Bisexual Individuals Recognized For First Time Ever In A State Of The Union Speech
WASHINGTON — President Barack Obama pushed for protections for lesbian, gay, bisexual and transgender individuals Tuesday evening, making it the first timebisexual and transgender individuals have ever been recognized directly in a State of the Union address.
“As Americans, we respect human dignity, even when we’re threatened, which is why I’ve prohibited torture, and worked to make sure our use of new technology like drones is properly constrained,” said Obama, adding, “That’s why we defend free speech, and advocate for political prisoners, and condemn the persecution of women, or religious minorities, or people who are lesbian, gay, bisexual, or transgender. We do these things not only because they’re right, but because they make us safer.”
Obama is also the first president to ever mention transgender individuals in any public speech, having done so in past contexts other than State of the Union addresses.
Obama declared marriage to be a “civil right” Tuesday night as well, just days after the Supreme Court announced it would take up the issue of marriage equality. This spring, it could finally rule whether it’s unconstitutional to bar same-sexcouples from getting married.

Obama, who came out in support of same-sex marriage in May 2012, also tied gay rights to the civil rights fight in his second inaugural address. He said it was “our generation’s task” to carry on what was begun at Seneca Falls, Selma and Stonewall — centers of the fight for women’s rights, African-American rights and LGBT rights, respectively.
“Our journey is not complete until our gay brothers and sisters are treated like anyone else under the law –- for if we are truly created equal, then surely the love we commit to one another must be equal as well,” he said.
Masen Davis, executive director of the Transgender Law Center in California, was thrilled with the inclusion of transgender and bisexual individuals in Tuesday’s State of the Union speech.
“I listened to the State of the Union with bated breath. President Obama’s public recognition of transgender people in his State of the Union address was historic,” he told The Huffington Post. “It is time for the American public to become aware of our stories and struggles both at home and around the globe.”
Last year, Obama took a number of steps to ban discrimination against the LGBT community, in particular transgender Americans. In July, he signed an executive order making it illegal to fire or harass employees of federal contractors based on their sexual orientation or gender identity. The order also explicitly banned discrimination against transgender employees of the federal government.
