Ninth Circuit Denies Another Trump-Pence Effort to Implement Transgender Military Ban

Today, the U.S. Court of Appeals for the Ninth Circuit denied yet another attempt by the Trump Administration to implement its discriminatory plan to ban transgender people from serving openly in the U.S. Armed Services. Today’s ruling in the lawsuit brought by Lambda Legal and OutServe-SLDN and joined by the State of Washington denied the administration’s motion to stay the preliminary injunction a lower court granted in December 2017, and affirmed last month. The injunction blocks implementation of the ban and enables transgender people to continue enlisting in the military.

“Seven courts across the country have considered this so-called plan, and seven courts have recognized that there is no defensible reason to bar transgender Americans from serving our nation,” Staff Sergeant Cathrine (Katie) Schmid said. “Being transgender has no impact on my ability to perform my duties. I’m grateful that the courts to date have recognized the value in our service, and I look forward to the day when we can put this argument behind us and focus on what’s really important– the accomplishment of our mission, and the welfare of our service members.”

“The Ninth Circuit, much like the six other courts to have considered the proposed policy, has recognized it for what it is – blatant and impermissible discrimination.  The court rejected the government’s attempt to ‘upend’ the status quo, as well as the lives of transgender people serving and seeking to serve our country.” said Lambda Legal Senior Attorney Peter Renn. “It has been one year since President Trump announced via tweet his plan to bar transgender people from the military, and in that year four district courts and, now, three courts of appeal have blocked its implementation. What more evidence does the administration need before it abandons this discriminatory and harmful scheme to prevent brave and qualified transgender people from serving their country?”

The Ninth Circuit ruling holds that the stay requested by the government “would upend, rather than preserve, the status quo,” which currently allows transgender people to serve in the military.

The Trump administration had sought a stay from the Ninth Circuit while it appealed the April 13 ruling of the U.S. District Court for the Western District of Washington affirming an earlier preliminary injunction and barring implementation of the transgender military ban.

The April 13 ruling rejected the Trump administration’s claim that its “new” plan to ban transgender people from serving openly in the U.S. Armed Services, released March 23, passed muster. Instead, the court found that plan to be a retread of the original ban, not a new policy, threatening the very same constitutional violations. Furthermore, the court also found that the effort to ban transgender people from military service must meet the most demanding level of scrutiny because it so clearly targets transgender people.

The case is on track to go to trial in April 2019.

”Every court ruling has been consistent and unequivocal: the ban on transgender military service is discrimination, no matter how it’s phrased and no matter the myriad ways the administration has tried to cloak its intent,” OutServe-SLDN Legal Director Peter Perkowski said. “The administration has failed to come up with any adequate rationale for the president’s ill-conceived tweets of last July that justifies their blatant discriminatory nature, and we are confident it never will.”

In the lawsuit, Lambda Legal and OutServe-SLDN represent nine individual plaintiffs – six currently serving members of the armed services and three individuals seeking to enlist – and three organizational plaintiffs: the Human Rights Campaign (HRC), Seattle-based Gender Justice League, and the American Military Partner Association (AMPA), who joined the lawsuit on behalf of their transgender members harmed by the ban.

We are grateful to Lambda Legal and Outserve-SLDN for their representation in this critical case, and we hope that the constitutional rights of transgender Americans will continue to be upheld by the courts as this case proceeds.”

“The Trump-Pence administration’s continued insistence on targeting our nation’s transgender service members for discrimination is truly deplorable,” said AMPA President Ashley Broadway-Mack. “These brave American volunteers have already proven their ability to serve by putting their lives on the line for our nation. What matters in service to our country is whether a person is able to accomplish the mission, not gender identity.”

Jude Law has broken his silence about the sexual orientation of his character, the young Dumbledore, in Fantastic Beasts: The Crimes of Grindelwald. Beasts director David Yates and author JK Rowling became embroiled in controversy earlier this year after it was reported that the character would not be “explicitly” gay.

In February, news broke that Yates would “not explicitly” reference young Dumbledore’s sexual orientation.

Last year, author J.K. Rowling hinted that Dumbledore’s sexual orientation would be addressed: “I can’t tell you everything I would like to say because this is obviously a five-part story so there’s lots to unpack in that relationship. … We’ll see him at that formative period of his life. As far as his sexuality is concerned … watch this space.”

Following Yates’ interview, fans took to Twitter to express their disappointment to Rowling, and she was having none of it, clapping back at fans on Twitter and telling them to be patient.

Law offered some of the same sentiment in a new interview with EW.

Said Law: “…as with humans, your sexuality doesn’t necessarily define you; he’s multifaceted. I suppose the question is: How is Dumbledore’s sexuality depicted in this film? What you got to remember this is only the second Fantastic Beasts film in a series and what’s brilliant about Jo’s writing is how she reveals her characters, peels them to the heart over time. You’re just getting to know Albus in this film, and there’s obviously a lot more to come. We learn a little about his past in the beginning of this film, and characters and their relationships will unfold naturally which I’m excited to reveal. But we’re not going to reveal everything all at once.”

Bethlehem City Council Passes Measure Protecting LGBTQ Youth from ‘Conversion Therapy’

Today, the Human Rights Campaign praised the Bethlehem City Council for passing a measure protecting LGBTQ youth in the city from the dangerous, abusive and discredited practice of so-called “conversion therapy.” The ordinance, which was introduced by City Councilmember Bryan Callahan and sponsored by Councilmember Shawn Martell, also had strong support from the Bradbury-Sullivan LGBTQ Community Center, KidsPeace Hospital, Valley Youth House, and Metropolitan Community Church of the Lehigh Valley. Bethlehem is the eighth Pennsylvania locality to pass such a measure following Reading, Allentown, Pittsburgh, Philadelphia, Doylestown, State College, and Yardley Borough.

“No child should be put through the dangerous and inhumane practice of conversion therapy which doesn’t work, and is tantamount to child abuse,” said Allison Van Kuiken, HRC Pennsylvania State Director. “That’s why this abusive practice has been condemned by every major medical and mental health organization, and why 14 states and Washington, D.C. have enacted laws or regulations to protect LGBTQ minors. We applaud the Bethlehem City Council and organizations like the Bradbury-Sullivan LGBT Community Center and Valley Youth House who made this possible, and remain committed to working with our partners in Pennsylvania and across the nation to ensure that young people are protected from this junk science in every jurisdiction.”

Said Adrian Shanker, Executive Director of Bradbury-Sullivan LGBT Community Center, “Bethlehem City Council’s unanimous support for an end to conversion therapy in their city is an important victory for LGBT youth and a clear reminder that the LGBT community deserves high-quality health care, not discredited junk science.”

So-called “conversion therapy,” sometimes referred to as “sexual orientation change efforts” or “reparative therapy,” encompasses a range of dangerous practices that seek to change an individual’s sexual orientation or gender identity or expression. These practices are based on the false premise that being LGBTQ is a mental illness that needs to be “cured” — a theory that has been rejected by every major medical and mental health organization.

HRC recently released a video featuring the story of Alex Cooper, a teen in Utah who was subjected to “conversion therapy” and tells the story of her abuse. Watch and share the video here.

There is no credible evidence that conversion therapy can change a person’s sexual orientation or gender identity or expression. To the contrary, research has clearly shown that these practices pose devastating health risks for LGBTQ young people such as depression, decreased self-esteem, substance abuse, homelessness, and even suicidal behavior. The harmful practice is condemned by every major medical and mental health organization, including the American Psychiatric Association, American Psychological Association, and American Medical Association.

In addition to Pennsylvania, a growing number of municipalities across the country, including cities and counties in Ohio, Washington, Florida, New York, Arizona, and Wisconsin, have enacted similar crucial protections. Connecticut, California, Nevada, New Jersey, the District of Columbia, Oregon, Illinois, Vermont, New York, New Mexico, Rhode Island, Washington, Maryland, Hawaii, and New Hampshire all now have laws or regulations protecting youth from this abusive practice, and similar legislation is currently awaiting gubernatorial action in Delaware.

According to a recent report by the Williams Institute at UCLA School of Law, an estimated 20,000 LGBTQ minors in states without protections will be subjected to conversion therapy by a licensed healthcare professional if state lawmakers fail to act. HRC has partnered with the National Center for Lesbian Rights (NCLR) and state equality groups across the nation to pass state legislation ending conversion therapy. Armie Hammer, who is starring in a new Broadway show called Straight White Men, stopped by The Late Show to chat with Stephen Colbert, and the convo turned to the gay drama Call Me By Your Name.

Hammer told Colbert that fans keep giving him peaches (as Colbert advises, “watch the film”) to sign.

Said Hammer: “I get handed at least a peach or two every stage door.”

Hammer said that most people don’t intend to eat the peaches, or use them the way they do in the film.

Hammer said he asks the fans what they’re going to do with it: “They’re going to put that peach on a shelf…and in ten days it’s going to putrefy and their entire place it’s going to be full of fruit flies.”

Added Colbert: “It’s an art installation.”

Quipped Hammer: “Yeah. Watch it wither like Donald Trump’s presidency.”

Colbert didn’t miss a beat: “Well, with Donald Trump’s presidency, like that peach, we are f**ked.”

Without naming him, President Barack Obama rebuked Donald Trump in the 2018 Nelson Mandela Annual Lecture in Johannesburg on Tuesday.

Said Obama: “You have to believe in facts. Without facts, there’s no basis for cooperation. If I say this is a podium and you say this is an elephant, it’s going to be hard for us to cooperate…I can’t find common ground if people say climate change is just not happening when almost all the world’s scientists tell us it is. I don’t know where to start talking to you about this. If you start saying it’s an elaborate hoax…where do we start? Unfortunately, too much of politics today seems to reject the very concept of objective truth. People just make stuff up. They just make stuff up…We see the utter loss of shame among political leaders where they’re caught in a lie and they just double down and they lie some more.”
