Kim Davis Asks Appeals Court To Let Her Refuse To Issue Marriage Licenses

MOREHEAD, Ky., Sept 12 (Reuters) – The county clerk from Kentucky who was jailed after refusing to issue marriage licenses to gay couples has asked an appeals court to let her continue her stand until a lawsuit against her is decided.

Rowan County Clerk Kim Davis, due back at work Monday after six days behind bars, has said her beliefs as an Apostolic Christian prevent her from issuing marriage licenses to same-sex couples and her attorneys have said the 49-year-old woman will not violate her conscience when she returns to work.

In her absence, deputy clerks have been issuing licenses and have said they would continue to do so.

Davis was jailed when she refused to comply with U.S. District Judge David Bunning’s order to issue licenses. He ordered her released when the deputy clerks began issuing the licenses.

In a Friday motion filed with the Sixth Circuit U.S. Court of Appeals, Davis’ attorneys asked that she be allowed to continue banning marriage licenses for her entire office until the case is settled.

Davis’ attorneys argued that Bunning’s initial order had only covered couples who were suing her. They said he violated her right to due process during her appeal when he expanded his initial injunction to include any couple legally eligible to marry, the filing says.

She should thus be allowed to continue her ban now that the couples covered under the first order have been issued licenses, the attorneys argue.

In a separate filing on Friday, her attorneys said “this case would be over” if the governor, using the same authority that allowed him to change the certificates to be gender neutral, would simply remove her name from the documents.

Bunning warned Davis in his release order that there would be consequences if she interfered with the issuance of marriage licenses when she returned to work. A deputy clerk has said he will continue to issue licenses.

On Tuesday, Davis walked out of the Carter County Detention Center to a roaring crowd. Her supporters continued protests last week after her release, demanding the firing of any deputy clerks who provide marriage licenses without Davis’s permission.

Her attorneys have said marriage certificates issued without her authority have been void.

The issuance of marriage licenses to same-sex couples in Kentucky and other states has become the latest focal point in the long-running debate over gay marriage that has continued even after a U.S. Supreme Court ruling in June allowed the practice nationwide.

Kim Davis‘ legal team is piling up the billable hours to keep her from doing her job. Yesterday, 11 September, lawyers for the Kentucky clerk who refuses to issue marriage certificates to LGBTI couples, filed another appeal.

According to MSNBC, the legal team for the Rowan County clerk filed papers with the Sixth Circuit US Court of Appeals. The Liberty Counsel lawyers maintain because the gay couples who sued received certificates when Davis was in jail, the office should not be required to process licenses for other LGBTI couples.

‘I hate to use a religious metaphor, given the circumstances,’  Sam Marcosson, a constitutional law professor at the University of Louisville, said to MSNBC, ‘but this strikes me as a Hail Mary pass.’

Liberty Counsel is a Christian law firm.

Since the Supreme Court ruled marriage equality is legal in all 50 states, Davis has balked at the decision citing her religious faith. Last month, US District Judge David Bunning ordered her to follow the law. The Democrat appealed to the Supreme Court, but the highest court in the country denied her emergency request to not issue certificates to any couplesgay or straight – as she fought in the lower court.

She continued to ignore the judge’s ruling. Bunning placed her in jail, for contempt, earlier this month. She was released on 8 September, but warned not to interfere with issuing of marriage certificates. Deputy clerks filed papers when she was away.

If the Sixth Circuit does not reply to Davis by Monday, the day she plans to return to work, she has two options: either allow the office to issues certificates, or ignore Bunning a second time.

Deputy Rowan County clerks promise they will file applications, even if Davis interferes.

Davis has been applauded by many on the religious right, including Republican presidential candidate Mike Huckabee.

Kim Davis isn’t finished trying to squirm her way out of having to issue marriage licenses to same-sex couples.

BuzzFeed’s Chris Geidner reports Davis’s lawyers asked a federal appeals court on Friday to effectively end the requirement that all couples be allowed to marry in the county.

The AP adds:

Attorneys for Kim Davis, who objects to gay marriage on religious grounds, argued in their motion to the Sixth Circuit U.S. Court of Appeals that all the same-sex couples who sued Davis for a license received one from her deputies while she was in jail. Therefore, they said, her office should not be required to issue them to any more couples once she returns to work.

U.S. District Court Judge David Bunning wrote that his mandate to issue licenses applied to all couples, not only those who filed suit. But Davis’ lawyers allege that order was issued improperly, and again have asked for a delay.

“I hate to use a religious metaphor, given the circumstances,” said Sam Marcosson, a constitutional law professor at the University of Louisville, “but this strikes me as a Hail Mary pass.”

Channel Islands celebrate its first ever Pride

The Channel Islands have held its first Pride march in Jersey today.

The event takes place from Friday to Sunday (11-13) which, besides the march, includes music, comedy and film shows.

Guernsey-based LGBTI advocacy group Liberate organized the event at which around 3000 people have been estimated attending.

The pride event indicates shifting attitudes on the British-controlled islands, which lie between England and France. Liberate are continuing to work toward marriage equality in the region, which could be as far away as 2017.

They announced on their twitter account the next event is already planned to take place in Guernsey next year.

Here’s a fun Labor Day weekend story… We just decided to add two new members to our Johnson family. Baby French Bulldogs. In my right hand is BRUTUS and in my left hand is HOBBS. Bring them home and immediately take them outside so they can start learning how to “handle their business and potty like big boys”. I set them both down and they both take off in a full sprint and fall right into the deep end of our pool. HOBBS immediately starts doggy paddling while BRUTUS (like a brick) sink heads first to the bottom of the pool. I take off into a full sprint, fully clothed, dive in the pool, swim to the bottom, rescue my brick, I mean BRUTUS and bring him back to the edge of the pool. He was a little delirious.. took a moment, threw up all the water he swallowed and looked up at me as if to say, “Thank God you didn’t have to give me mouth to mouth!” and then ran off to play with his brother. A few lessons I’ve learned today.. A) Not all puppies have the instinct to doggie paddle. B) Some puppies (like BRUTUS) will be so in shock by experiencing water they will sink extremely fast so react quick. C) While spiriting to save your puppies life, before you dive in, try and throw your cel phone to safety. Don’t keep it in your pocket… like I did. #BRUTUSLives #HOBBSCanSwim #MyCelPhonesDead #AndNoMouthToMouthNeeded #HappyLaborDay

Following their exchange Lovato joins actor Tom Hardy on the couch and Hardy responds to rumors that he has been lined up to play the next James Bond.

Hardy and Lovato then play a game of ‘Heavyweight Dubsmash’ in which they face off lip-synching Whitney Houston’s “I Will Always Love You”, and finally, Lovato performs “Cool for the Summer”.

Meet the gay classical star who’s painted his body like a piano to get more people into music

A British classical pianist is bringing his art form to a new audience by painting his body to look like a piano.

While pop stars or opera singers are able to use their body as their instrument, 26-year-old Emmanuel Vass wanted to explore the relationship between the artist and the piano – by transforming his muscular arms and torso into painted black and white keys.

‘As a piano player I play something external, but it is a part of me – there has to be a connection between you and the instrument,’ he explained, speaking to Gay Star News. ‘I wanted to explore that link.’

‘I was thinking carefully about how classical music is represented in mainstream media. When a lot of people think about classical music they think about an introverted, anaemic-looking person standing meekly on the stage. That’s not me at all, and it’s the complete opposite of my training!

He added: ‘I don’t think it’s necessary to wear clothing from the 19th Century when you’re playing music from that time. I don’t have to look like Mozart when I’m playing his music!

‘It’s a bit like saying One Direction should look like the Beatles to be good pop stars. When you put it like that, it just sounds insane.’

While he’s happy to show the sexier side of his art form, Vass understands his topless photos are bound to shatter a few champagne glasses among the classical elite, who generally expect a performer to be wearing at least a shirt – if not a suit.

‘Some people have reacted in a negative manner,’ he said. ‘As an artist you can never please everybody all the time across the board. I feel personally that I am bringing something new to the table. Nobody has ever done this before in classical music!

‘Controversy drives art forward in many ways. It’s about pushing boundaries and driving discussion and always being at the forefront of vision. We don’t need to look back to the 19th Century – we should embrace what’s going on right now!

‘We live in a social media age, a smartphone age; the general public do look before they hear. If you have some striking visuals they might be more likely to want to listen to the piano for the first time.’

He added: ‘I completely acknowledge I’ll probably piss some people off… but Brahms pissed people off too, right? Stravinsky wrote a ballet that caused people to riot and run out of the theatre – but now that ballet is seen as the pinnacle of contemporary music and completely changed the way we understand the music that followed.’

‘The quality of my playing is still inherent – it’s been broadcast by Classic FM and BBC Radio 3, and my album was at the top of the UK classical charts a few months ago – so I don’t think I’m taking it too far.’

‘The most important thing is always the music, and the way I look doesn’t actually affect the way I play. It just might turn a few heads in the right direction, that’s all.’

‘So many musicians are objectified for their talent; either that or you’re a ‘youth object’, or a ‘hero object’ – so why can’t you be a ‘sex object’?’ he said.

‘That’s not necessarily what I’m aiming for, but if that’s what I’m being perceived as, then why not?!’

‘I’m a pianist who pumps iron and goes to the gym – I don’t want to hide that under a suit! I enjoy exercise and running with my dog. That’s part of my life, just like playing is.’

So what does his partner make of his unconventional classical photoshoot?

‘My boyfriend has been very supportive,’ he explained. ‘It’s part and parcel of having a career – you have to do some promotion for your music, after all. He takes it as a compliment that I’m getting attention!’

Anyone expecting to get a glimpse of Vass’s body-painted torso at an upcoming concert might have to wait until the warmer months; while he won’t be wearing a Mozart costume, the pianist is planning on wearing a few more clothes as he tours the UK.

‘The music deserves a certain level of respect,’ he said. ‘I wouldn’t go on stage in my piano outfit; you’re in danger of making it a circus if you take it too far. Besides, my next concert is in the Chapel Royal in Brighton, then I’m playing at St Mary Redcliffe in Bristol on the 26th of September – it’s a little cold at that time of year to be strutting around topless!’

michael-stipe-1024This week, Survivor made headlines after one Kimberly Davis of Rowan County, KY used one of their songs — “Eye Of The Tiger” — as her freedom-America-homophobic anthem.

“The song has motivated thousands through the years to reach beyond their limits,” band co-founder Jim Peterik told Billboard. “Its use for the release of Kim Davis does not support my views or my politics.”

A few days later, out R.E.M. frontman Michael Stipe had these words for one Donald Trump after Stipe learned Trump has been using “It’s the End of the World As We Know It (And I Feel Fine)” at campaign rallies:

“Go fuck yourselves, the lot of you – you sad, attention-grabbing, power-hungry little men,” Stipe said in an email to The Daily Beast. “Do not use our music or my voice for your moronic charade of a campaign.”

We wanted to take a look back at the rich American tradition of musicians telling antigay, conservative politicians to — in Stipe’s poetic words — “go fuck yourselves.”
