Secretary of Education Betsy DeVos Rolling Back Sexual Assault Protections

Today, HRC expressed grave concern over the decision by U.S. Secretary of Education Betsy DeVos to begin a process to rescind 2011 Title IX guidance related to schools’ obligations to address sexual harassment, including sexual violence.

Title IX of the Education Amendments of 1972 (Title IX) explicitly prohibits sex discrimination in any educational program or activity that receives federal funding. While historically known for its impact on women’s athletics admissions, Title IX’s prohibition on sex discrimination, as a matter of law, also requires schools to address sexual harassment, including sexual violence, as forms of sex discrimination. In addition, Title IX protects students from discrimination on the basis of gender identity and sexual orientation, as evidenced by continuing case law, guidance previously issued by the Department of Education, and school district settlements to this effect.

“With today’s announcement, Betsy DeVos is insinuating that she would prefer to take America back to a time when it was more difficult for survivors of sexual assault to receive justice,” said Sarah Warbelow, legal director for the Human Rights Campaign. “For the LGBTQ community, which faces disproportionate levels of sexual assault and violence, this decision sends a strong signal that the U.S. Department of Education will not use its full power to protect them from harm. This signal is only amplified and worsened by the actions the department took earlier this year when it callously rescinded guidance aimed at protecting transgender students.”

LGBTQ Americans are disproportionately affected by sexual assault and harassment and the stigma that many LGBTQ people face can make it more difficult for survivors to report. Studies suggest that around half of transgender people and bisexual women will experience sexual violence at some point in their lifetimes. According to the Youth Risk Behavior Survey, a national survey of high school students, lesbian and bisexual women and gay and bisexual men experienced higher rates of sexual assault than their straight counterparts. In addition, a 2015 study by the Association of American Universities found that 60 percent of gay and lesbian students and nearly 70 percent of bisexual students report being sexually harassed on campus.

Today’s action comes only months after the Department of Education elected to rescind guidance it had issued, consistent with established case law on the matter, to provide schools with best practices about eliminating discrimination in education on the basis of gender identity. The Department of Education, through a series of “Dear Colleague” letters, guidance and FAQ documents, has previously clarified that Title IX’s prohibition on sex discrimination includes gender-based harassment of students, including harassment by a person of the same sex, harassment for “failing to conform to stereotypical notions of masculinity or femininity,” discrimination against transgender and gender nonconforming students, and failure to respect transgender students’ gender identity when operating single-sex classes.

‘Angels in America’ to Be Revived on Broadway with Andrew Garfield and Nathan Lane

 

Tony Kushner’s epic play Angels in America is being revived on Broadway 25 years after the original in a production that was staged earlier this year by London’s National Theater.

The NYT reports:

The revival will star Nathan Lane, the acclaimed stage actor (“The Producers”), as the anti-Communist lawyer Roy Cohn, as well as Andrew Garfield (“Hacksaw Ridge,” “The Amazing Spider-Man”) as Prior Walter, a gay man with AIDS, and Denise Gough (“People, Places and Things”) as Harper Pitt, a Mormon woman with a fondness for Valium.

Seven of the eight cast members are following the production except for Russell Tovey who has a conflict. The play, directed by Marianne Elliott, is set to begin previews in February and open March 23.

GLAAD announces San Francisco Rising Stars Grant recipients

GLAAD is pleased to announce the recipients of its 2017 Rising Stars Grants at the GLAAD Gala San Francisco.

The GLAAD Rising Stars program empowers and invests in the next generation of LGBTQ change makers, whose advocacy is changing their local communities and the culture at large. Grants are awarded annually to LGBTQ youth and support initiatives that champion intersectional LGBTQ issues, including racial justice, immigration rights, trans equality, and more.

The Rising Stars Grant recipients at the GLAAD Gala San Francisco, presented by Target, Turner, and Barilla, will be honored for their work that uses social media, digital media, or technology to enhance LGBTQ experiences online and in their communities.

Recipients will be recognized at the Rising Stars Luncheon taking place at the InterContinental in San Francisco on September 8th, 2017.

The Rising Stars Luncheon will be hosted by YouTuber Kat Blaque, and will feature presenters activist Blair Imani, actor Tommy Dorfman, YouTuber Riley Jay Dennis, and DJ Zeke Thomas, with special guests GLAAD President and CEO Sarah Kate Ellis, and poet Royce Mann, all of whom are notable for their contributions to LGBTQ visibility and fair representation in the media.

Recipients of GLAAD Rising Stars Grants will also attend the GLAAD Gala San Francisco, which honors leaders in the tech and digital media industry whose work positively affect LGBTQ communities.

Barilla Cultivation Grant

Lindsay Amer is a queer activist, artist, storyteller, and educator based in New York City. They create and host Queer Kid Stuff, an LGBTQ+ educational web series for all ages on YouTube. Lindsay strongly believes that queer-inclusive media representation for kids helps create a kinder and more equal future. As a Rising Stars Grant Recipient, they will produce a third season of Queer Kid Stuff, focusing on age-appropriate queer-inclusive sex education and introducing new vocabulary and concepts to the series, like “non-binary,” and how to think about gender and sexuality as spectrums.

Dani Marrero

Target Trailblazer Grant

Dani Marrero Hi is a Mexican immigrant raised in the Rio Grande Valley of South Texas. She is the creator of Neta, an online multimedia platform for citizen journalism to amplify the voices of border residents on social and political issues. As a Rising Stars Grant recipient, Dani will continue working with the dedicated team of storytellers in the Rio Grande Valley to keep creating positive and authentic media representation for border residents.

Prince Shakur

Turner Visionary Grant

Prince Shakur is a queer Jamaican American artist born and raised in Cleveland, OH, and holds a degree in Creative Writing from Ohio University. After the shooting death of Michael Brown, he dove headfirst into activism, including visiting Ferguson, marching for NUIT DEBOUT in Paris and protesting the Dakota Access Pipeline in Standing Rock, ND. The Rising Stars Grant will support his work as a freelance writer for publications like Teen Vogue, and his project Two Woke Minds, a travel series highlighting social issues abroad and in the U.S.

“When I was young you’re with your family, your brother, your sisters. They would say “you will grow up to have a wife” and I always (laugh) said “I would never” and I was very girly (laugh).

I protect my family, you know, I show to be gay is not to be the shy of my family. You must respect. For example, with your cousin you must study good, have a job. When you have that they can forget that you are gay. Because your mom has to be proud of your life.

I didn’t grow up in an African community, I arrived in Europe at 3 years old and I went to school in different parts of France and there were no black people- only me- all the people were white. And after during holiday I can see my family. But not too much.

I want my family to be proud of me. To be proud of my life. Being gay- you don’t want to change in the eyes of your family.

I’m a very difficult person and when I want something or want to prove something, everyone must accept me as I am. I stay very quiet and respect, but if you don’t like I don’t care. I prefer to be alone, if you hate me it’s your problem.”
