Federal Judge Overturns Nebraska Gay Marriage Ban
A federal judge has ruled Nebraska’s statewide ban on gay marriage unconstitutional.

U.S. District Judge Joseph Bataillon issued the ruling Monday, saying county clerks will be permitted to begin issuing gay marriage licenses on March 9.

“[A]ll relevant state officials are ordered to treat same-sex couples the same as different sex couples in the context of processing a marriage license or determining the rights, protections, obligations or benefits of marriage,” he wrote in the order.

The Nebraska attorney general’s office has already said it will appeal the judge’s order. Attorney General Doug Peterson is confident the Eighth Circuit Court of Appeals will grant the appeal.

Bataillon has struck down the state’s ban on gay marriage before; in 2005, the judge ruled the ban unconstitutional, but the Eight Circuit reversed his decision in July 2006.

The news comes just after the state lifted a 20-year-old ban on gay people becoming licensed foster parents. The policy barred unmarried, unrelated adults who live together from fostering parents, extending its reach to same-sex couples and people who identify themselves as homosexual — even those living without a partner.

MikulskiSenator Barbara Mikulski (D-MD), the longest serving Congresswoman in U.S. history, will retire from the Senate after five terms, the Washington Post reports:

Mikulski, 78, was the first woman to chair the powerful Appropriations Committee, a post she had to give up this year when the Democrats lost control of the Senate. A social worker turned politician, she has been a forceful presence on many pieces of legislation, passionately liberal on certain issues but also committed to working closely with Republicans.

Mikulski will make the announcement at an 11 am news conference, according to the paper.

French Director Paul Verhoeven Sues Cannes Film Festival For Rejecting Movie
A French director is suing the Cannes Film Festival for rejecting his work.

Paul Verhoeven, 73, who shares the same name as the famous Dutch director behind “Total Recall” and “Robocop,” claims that selectors rejected his film, “Teenagers,” because they were “homophobic,” The Telegraph reports.

The film, which covers a wide array of issues including terrorism, teen sexuality, homophobia and suicide, received poor reviews when it was released in 2009, Variety reports. It did, however, manage to win a few prizes at minor festivals around the world, including best narrative feature at the California Film Awards in 2011.

Verhoeven reportedly wants the festival to be forced to show his flick or pay for it to be screened in theaters. A ruling on the lawsuit is due later this month.

The claims of homophobia against the festival have come as a surprise to many Cannes regulars. Last year, British drama Pride debuted at the festival –- and went on to win the coveted Queer Palm -– while in 2013 the Palme d’Or was won by Blue is the Warmest Colour.

Alaskan Tribal Council Representing Tlingit and Haida Indian Tribes Moves To Recognize Gay Marriage

The joint council representing the indigenous Tlingit and Haida Indian Tribes of Alaska have unanimously agreed to amend traditional tribal laws in order to recognize same-sex marriages.

“We are pleased to expand our Tribal Court to meet the needs of our tribal citizens,” said Tribal Court Chief Justice Debra O’Gara in a prepared statement. ”Our court can now be utilized by tribal citizens for the happy occasion of marriage without discrimination and regardless of gender.”

The Tribal Council’s new decision will maintain the tradition of requiring that at least one member of a couple be an active and enrolled member of the Central Council of Tlingit and Haida Indian Tribes.

According to Tribal President Richard Peterson there was no one couple in particular that was agitating for the change in tribal law, but rather the Council’s decision came at a time that felt right and in accordance with the public’s current spirit.
